 On the 7th of July  2018, the Law of Ukraine "On Currency and Currency Operations" No. 2473-VIII entered into force.   The law will enter into force fully in seven months (ie February 7, 2019). At the same time, six months of the transition period is given for the completion of regulatory acts by the National Bank, which must ensure the implementation of the norms of the Law. After that, the regulator is obliged to publish  the specified regulatory legal acts not later than 30 calendar days before the day when the Law will enter into force fully.

Immediately after the introduction of the Law, a number of currency restrictions will be canceled, in particular, registration of loans from non-residents in the NBU, individual NBU licenses for investing abroad and opening accounts in foreign banks, currency control over operations in the amount of less than 150 thousand hryvnia.

Also there are several  innovations: the status of currency values ​​is granted to electronic money. Operations with electronic money refer to currency transactions. The transfer of electronic money abroad is considered a cross-border transfer of currency values ​​and subject to appropriate legal regulation.

Also, the National Bank has still a wide scope of powers  - has the right to introduce such "protection measures":

 

1) compulsory sale of the part of proceeds in foreign currency within the limits provided for by legal acts of the National Bank of Ukraine;

 

2) setting the deadlines for payments for operations of  the export and import of goods;

 

3) establishing the specifics  rules for operations related to the movement of capital;

 

4) the introduction of permits and (or) limits on the conduct of certain currency transactions;

 

5) reservation of funds for currency transactions;

 

6) measures, in accordance with Article 7-1 of the Law of Ukraine "On the National Bank of Ukraine", an exceptional list of which is determined by the regulatory legal acts of the National Bank.

 

BUT in this case, the total duration of the protective measures will not exceed 18 months within two years from the date of their first introduction. The NBU Council will also confirm the signs of the crisis.

 

Also, the Law adds the basis for recognizing a foreigner as a resident in order to implement the requirements of banking legislation, namely the registration of such a foreign citizen by a private entrepreneur.
