The Police officer, who used guns on the 07^th of February  in Kiev to stop a BMW (result of such case was the death of the injured teenager), today issued the suspicion of committing a crime.

In which cases police has the right to use weapons?

"The investigation established that the police during a car pursuit of BMW keenly aware that in the car except the offender of traffic rules there were three bystanders. Although he decided to use firearms, made shots toward the car, and expressed his intention to commit murder." - said the military prosecutor Anatoly Matios.

Paragraph 7 of Article 46 of the Law "On the national police" gives to the police the opportunity to use weapons only in respect of a vehicle by damaging it   if  its driver through their actions endanger the life or health of people and / or the police.

This fact - the creation of a threat also still nesessary to prove.

Contrary to popular belief in society  that the died teenage was a accomplice to crime necessary to note: the passenger is not a party of an administrative offense! According to the Administrative Code – participation for administrative offense does not exist.
