Citizen of Russian Federation Mr. Laptev went to Constitutional Court because of death of his brother, which was found hanged in the police station of Yoshkar-Ola in 2012. Investigators denied access to documents about details of the death of his brother because of the law "About State Secrets”. Because of this, Laptev could not appeal against the refusal to investigate his brother's death.
So, Constitutional Court concluded that the existing rules are consistent with Constitution of Russia, but the rights of the legal assistance, a representative of a person who requires about information about the death of his close relatives should not be limited! Constitutional Court gave an important clarification: in the required volume ALL documents concerning the events that concern the threat to life, and in this case - the death must be give to relative of dead person or his representative, but excluding those documents which are not relevant to the case and which are including a state secret. In this case, if the document contained a state secret, such document may be given, but with protection of disclosure.
Interesting actual sideeffect: In this case decision of Court was done on the next day after the decision of Chief Military Prosecutor of Russia WHICH officially recognized that the circumstances of the death of Pskov paratroopers are state secrets!
