11.09.2014 Russian actions in the aggression against Ukraine are even crimes under the Criminal Code of the Russian Federation

 

Criminal Code of Russia  has  separate chapters about crimes against the peace and security of humanity.  This crimes are international crimes.

So,

Article 353 Planning, preparation, initiation or waging of aggressive  war:

  1. Planning, preparation, initiation  of  aggressive war - is punished with  imprisonment for a term from  seven to fifteen years.
  2. waging of aggressive  war - is punished with  imprisonment for a term from  ten to twenty years.

The objective side of this crime consists of four kinds of socially dangerous actions: a) planning  of aggressive  war; b) preparation, c) initiation , d) waging of aggressive  war.

Preparation of war are actions to ensure appropriate plans.

Initiation  of aggressive war - is the beginning of concrete actions on territory of other country. These include f.e.: the invasion or attack by the armed forces of one State on the territory of another State, or any military occupation or annexation;   attack by the armed forces of one  State on the land, sea or air forces or fleets of another State, ets.

The subject of this crime is the person holding the highest public position of the Russian Federation -  President of the Russian Federation.

Article 359 Mercenary.

1. recruitment, training, financing or other material support of mercenaries, as well as its used in armed conflict or military operations - shall be punishable with  imprisonment for a term from  four to eight years.

2 The same acts committed by a person using his official position or against a minor - is punished with  imprisonment for a term from  seven to fifteen years with confiscation of property or without it.

3 Participation of a mercenary in an armed conflict or military operations - shall be punished with imprisonment for a term from  three to seven years.

Note: A mercenary is a person who acts in order to obtain material compensation and not a citizen of a State of armed conflict, without permanent residence of its territory.
