Kyiv City State Administration complained to court against the party "Batkivstina", "Udar", and others and asked about limitation of the right for peaceful meetings, because such planned actions (about which Kyiv City State Administration was notified in advance) are threat to national security, public order and the rights and freedoms of citizens. Administrative Court satisfied this claims and also pointed to the well-known fact that the crowd creates a heightened level of danger for everyone, in particular increases the possibility to become ill of various kinds of disease (grip, tuberculosis), and also there is a difficult situation to maintain personal hygiene and cleanliness.
Administrative Court came to the conclusion that exist the real danger to the national security, in particular its nice possibility FOR preparation for crimes, for damaging health, rights and freedoms of citizens.
So, NOT ALLOWED for parties "Batkivstina", "Udar", "People's Solidarity” and for other subjects, who wants to make peaceful meetings to do ANY activities, use loudspeakers, vehicles, posters, to install tents, stages from January 8 to March 8, 2014 in Kiev, at the following addresses:
площадь Михайловская с прилегающими улицами: Трехсвятительская, Десятинная, Михайловская, площадь Европейская с прилегающими улицами: Трехсвятительская, Костельная, Владимирский спуск; парк Тараса Шевченко с прилегающими улицами: Льва Толстого, Терещенковская, Владимирская; бульвар Тараса Шевченко, улица Грушевского, Мариинский парк и парк «Крещатый», включая улицы Садовая, Банковая, Институтская, Лютеранская, Крещатик, Архитектора Городецкого, Академика Богомольца, Шелковичная, Пилипа Орлика, Герцена, Командарма Каменева, Гусовского, Резницкая, Майдан Независимости, включая прилегающие улицы.
BUT necessary to say about the procedure for enforcement of judgments. According to the Law of Ukraine "About enforcement Proceedings" (Article 8) - party debtor in enforcement proceedings is a natural or legal person, determined by the executive document. According to Article 18, the executive document must contain full name of a natural person acting debtor, his place of residence or stay, personal identification code or number and passport series.
If the judgment is made against several persons, the court has the right to issue several executive document in which necessary to specify exactly which part of the judgment to be executed for EACH person. Thus, to implement enforcement of the Administrative Court impossible, because «other subjects, who wants to make peaceful meetings “ can not be subjects of responsibility.
It should also be noted that the European Court of Human Rights in the case "Verentsov against Ukraine" (April, 2013) drew attention to the absence of a clear legislative regulation of the right for peaceful meeting in Ukraine, which is maybe the reason for issuance of such decisions by the Ukrainian courts.
